Skinshark Trading Terms and Conditions
For users trading via the skinsauna.gg platform
1. Scope and parties
These Terms and Conditions ("Terms") apply to all purchases, sales, and exchanges of digital virtual items in Counter-Strike 2 ("Skins") facilitated through the Skinshark trading feature (the "Service") hosted on the skinsauna.gg website.
By accessing or using the Service, you ("User", "you") agree to be bound by these Terms. Please read carefully, as this Service operates under a tripartite legal and operational structure:
- Skinshark (Hong Kong Xunsha Cloud Technology Co., Limited): Acts as the Merchant of Record. Skinshark is the sole buyer and seller of Skins in all transactions. You are entering into a commercial trading agreement strictly with Skinshark.
- Skinsauna Oy: A Finnish company providing the skinsauna.gg website interface and marketing platform. Skinsauna Oy is not a party to any skin transactions, does not take ownership of user skins, and holds no commercial or tax liabilities regarding your trades.
- Skin Partners Oy: A Finnish company acting exclusively as a payment processor on behalf of Skinshark.
2. Eligibility and account
You must have the legal capacity and authority to enter into binding commitments under the laws of your jurisdiction (and be at least 18 years of age) to use the Service.
You acknowledge and agree that Skinshark and Skin Partners Oy may require identity verification, documentation, and additional information (KYC) to comply with anti-money laundering (AML), counter-terrorist financing, sanctions, and other legal or regulatory obligations. You must promptly provide any requested documentation.
3. Nature of the service and relationship to Valve Corporation
Skins are digital virtual items in Counter-Strike 2 whose ownership and transferability are subject to the technical and contractual terms of Valve Corporation and the Steam platform ("Valve/Steam Terms").
Skinshark, Skinsauna Oy, and Skin Partners Oy are independent third parties and are not affiliated with, endorsed by, or in any way officially connected to Valve Corporation or the Steam platform. All transfers of Skins via the Service are subject to the availability and functioning of Valve/Steam systems.
4. User location, VAT, and tax compliance
To comply with applicable tax and other legal obligations, Skinshark must determine the country in which you are located when you use the Service ("Location Information"). For this purpose, we will collect and process your self-declared country of residence and your IP address at the time of each transaction.
You expressly acknowledge and agree that:
- Accuracy: You will provide truthful, accurate, and complete information regarding your country of residence and current location.
- VPN Prohibition: You must not use the Service while using a VPN, proxy, Tor, or any other tool designed to hide, alter, or misrepresent your actual IP address or geographic location.
- Exemption of Skinsauna Oy: Because your skin transactions are executed exclusively with Skinshark, Skinshark is solely responsible for all Value Added Tax (VAT), sales taxes, and accounting obligations arising from your trades. Skinsauna Oy merely provides the website interface and is entirely protected and exempt from any VAT or tax liabilities resulting from your use of the Service.
5. Transactions and payment processing
All prices for buying, selling, or exchanging Skins are determined by Skinshark at its discretion, considering market conditions. By submitting an order to buy, sell, or exchange a Skin, you make a binding offer to enter that transaction under the conditions and price shown to you.
- Payment Processing: All fiat transactions, including credit card deposits, are processed by Skin Partners Oy, acting strictly as a payment processor on behalf of Skinshark. Skin Partners Oy collects your deposits and forwards them to Skinshark (minus a processing fee). Skin Partners Oy is not the seller of the Skins.
- Market Volatility: The value of Skins is highly volatile. No guarantee is given that any Skin will maintain or increase its value, and you acknowledge that neither Skinshark nor Skinsauna Oy is responsible for market price fluctuations.
6. Refunds and cancellations
When you purchase a Skin, the transaction involves the delivery of digital content in electronic form. By submitting a purchase order, you expressly request that delivery of the digital content commences immediately upon acceptance of your order.
You acknowledge and agree that once delivery of the digital content has commenced, you lose your statutory right of withdrawal.
Refunds are granted by Skinshark only if:
- The transaction did not complete due to a technical error;
- The Skin was not transferred to the buyer despite successful payment; or
- There is demonstrable fraud or technical failure attributable to the Service.
Simple changes of mind or market price changes do not qualify for refunds. All refund requests must be directed to Skinshark support.
7. Limitation of liability and indemnification
To the maximum extent permitted by applicable law, Skinshark, Skinsauna Oy, and Skin Partners Oy shall not be liable for any indirect or consequential damages, including loss of profit, loss of data, or loss of business.
Indemnification of Skinsauna Oy: You agree to indemnify, defend, and hold harmless Skinsauna Oy from and against any claims, tax liabilities, losses, damages, fines, or expenses arising out of your use of the Skinshark trading feature, your provision of false Location Information, or your failure to pay taxes.
8. Governing law and dispute resolution
For matters relating to the skin trades and terms of service, this agreement is governed by the laws of Hong Kong SAR, as per Skinshark's operational jurisdiction. For matters specifically relating to payment processing and statutory consumer rights (if you reside in the EU/EEA), local mandatory laws and the laws of Finland may apply to Skin Partners Oy and Skinsauna Oy.
